Judge D.R. Shynkar
A man clad only his underwear while resisting arrest was told to comply with police no matter what he was wearing.
Barton Burback, 57, of Enilda was sentenced to 30 days in jail on one count of assault and resisting arrest after appearing in High Prairie provincial court April 11.
“Simply allow yourself to be arrested even if you’re stark naked in the shower,” Judge D.R. Shynkar told Burback.
Charges arose when an intoxicated Burback put up a fight while being arrested by High Prairie RCMP in his home on April 5. Hadyn Shook, Crown prosecutor, told court the incident began when a neighbour reported that Burback smashed a glass plate on a table at his home. Officers were hit by his elbow as they tussled with Burback, who fled to his bedroom.
Burback was in bed wearing just his underwear when officers knocked on the door to apprehend him, said his lawyer, Harry Jong.
“He just wanted to put on some clothes and look dignified.”
Burback was also fined $300, plus a $90 victim fine surcharge, for mischief to property for the damage.
Admitting to an alcohol problem, he wants to get treatment.
Burback will serve another 22 days. He already spent eight days in custody before entering his plea.

Christopher Super- nault, 41, was sentenced to 14 days in jail for driving a motor vehicle while unauthorized.
“This is the second offence [of that charge] in one year,” Judge D.R. Shynkar said. “It’s a mandatory 14-day sentence.”
The Crown reported it was Supernault’s third conviction for driving while unauthorized.
A request to serve the sentence on weekends was granted.

Charles L. Chalifoux, 40, of Driftpile was fined $1,500, plus a $450 victim fine surcharge, for driving a vehicle over the blood-alcohol legal limit of .08 mg.
Chalifoux was driving a quad when he was caught well over the legal limit. His breath samples were 280 mg, over three times the legal limit.
“Mr. Chalifoux actually flipped his quad,” said Crown prosecutor Hadyn Shook.
Chalifoux was automatically suspended from driving a vehicle for one year.
“He is remorseful,” says Cheryl Kachuk, criminal court worker for Native Counselling Services of Alberta.
“He knows he shouldn’t have done it.”

Rodney Lalonde, 37, was fined $1,000, plus a $300 victim fine surcharge, each on charges of breach of probation and mischief to property.
Lalonde was serving an intermittent sentence on weekends at the High Prairie RCMP detachment, but he breached a condition to report sober April 1.
On April 8 while in custody, he plugged the toilet with a newspaper and flushed it several times, caused water to overflow.
“This is similar to obstructing a peace officer because it interferes with the work of officers who were serving others in the cells,” said Hadyn Shook, Crown prosecutor.
Lalonde was told he misused a privilege.
“You were given an intermittent sentence as a benefit,” said Judge D.R. Shynkar.
“I understand my behaviour was wrong,” said Lalonde. “I promise I will not mess it up.”
